It may also breach your duties under safety legislation (this may lead to prosecution) and your contract (this may be classed as gross misconduct and lead to disciplinary action or dismissal). Inaccurate information may also invalidate your insurance and the employer’s liability protections.  OH assessments are medically confidential and focus on advice rather than detailed medical history. You can review the OH report before it’s shared with your employer and withhold consent (unless safety is at risk). Health information is shared only on a need-to-know basis, complying with data protection laws. The Equality Act 2010 protects you from discrimination based on health conditions.
