Is occupational health mandatory in the UK? Do I have to attend an OH appointment?

Under UK law, occupational health (OH) assessments for non-safety-critical work are voluntary. However, employers may request workers to attend in accordance with the Health and Safety at Work Act 1974, which requires workers to cooperate in health and safety matters. The attendance may be required contractually.
In safety-critical roles, the Health and Safety at Work Act 1974 (HASAW) requires employee cooperation for workplace safety. Refusal might lead to HSE violations or dismissal if there are substantial health and safety risks (e.g., a forklift truck driver with epilepsy).

What not to say to occupational health in the UK? What if I lie to occupational health?

Honesty is critical in occupational health assessments to mitigate legal and safety risks. Effective communication during all medical consultations, including OH assessments, ensures accurate recommendations. Being open and honest allows OH clinicians to understand your health and give advice to promote your safety, health and well-being at work.

Withholding information or lying during an OH assessment can impact safety, legal compliance, and your employment. It may also hinder the opportunity to consider support.

For example, concealing epilepsy or diabetes can endanger you and others, especially in high-risk roles. It may also breach your duties under safety legislation (this may lead to prosecution) and your contract (this may be classed as gross misconduct and lead to disciplinary action or dismissal). Inaccurate information may also invalidate your insurance and the employer’s liability protections.  

OH assessments are medically confidential and focus on advice rather than detailed medical history. You can review the OH report before it’s shared with your employer and withhold consent (unless safety is at risk). Health information is shared only on a need-to-know basis, complying with data protection laws. The Equality Act 2010 protects you from discrimination based on health conditions.
